Introduction

smoking policySmoking is prohibited in all buildings of the UT; in public spaces as well as work places. The smoking ban also applies to off-hours and in buildings that have been put out of use because of renovation work. The principal tenant of a building is responsible for compliance with any agreements with regard to non-smoking areas. In case of violation of the Tobacco Act, the NVWA imposes a fine (€ 600 – 4500) on the employer. The UT will recover these fines in full from the perpetrator personally.

The entrances of each building state that a general smoking ban is in place in the building in question. If a smoking area is available in or near a building, it will be signposted where it is located.

The principal tenant of a building can designate spaces within and/or outside the building where smoking is allowed. Smoking areas are realised in consultation with and by the Facilities Department. The costs are for the principal tenant. These smoking areas may not be used as working space. No smoking nuisance may be created outside a smoking area in any way whatsoever. In practice, this means among other things that, in buildings, rooms need to be closed (for example by door-closers) and that the air is discharged outside, so that there will be no nuisance or inconvenience outside this smoking area. For spaces outside the building in general this means that such spaces may not be situated close to any entrance and not in the immediate vicinity of rooms that can be opened.

New smoking policy

From April 2014, the smoking policy of the University of Twente is as follows:

Smoking is prohibited in all UT buildings, both in public spaces and in all work places. The ban also applies to all spaces on the UT premises that have a catering destination.

The smoking ban also applies outside office hours and in buildings put out of order in connection with renovations.

Per unit/building it may be decided to allow smoking in one or more smoking areas specially arranged for smoking. The costs for this are borne by the unit. These smoking areas may not be used as a work space. If the building has a smoking area, it will be indicated at the entrance where it is located.

4.

Per space with a catering destination it can be decided to allow smoking in a specially arranged smoking area. The costs for this are borne by the licensee. No food and drinks will be served in these closed spaces. Posters/pictograms indicate where smoking is allowed.

5.

In case of violation of the Tobacco Act, the Dutch Food and Consumer Product Safety Authority (NVWA) will impose a penalty. The UT will fully recover these penalties from the offenders personally.

The smoking ban also applies to electronic cigarettes.

The main tenant of a building is advised to designate one or more places outside the building (not being at the entrance or in the immediate vicinity of rooms that can be opened) where smoking is allowed and to place ashtrays here.

In order to meet smokers, setting up separate smoking areas is allowed but not compulsory.

Per unit/building it can be decided to allow smoking in one or more specially arranged smoking areas. These spaces may only be used as smoking area. The costs for this are for the unit, or, in case of spaces with a catering destination, for the licensee. The Act does not provide any specific guidelines or standards for such smoking areas. One requirement is that no nuisance in any form is caused outside the smoking area. In practice this means among other things that the space is to be closed (for example by doors fitted with a door-closer) and that the air is carried off outside, so that there is no smoking pollution outside of this smoking area.

At the entrance of each building it is indicated that a general smoking ban is in force in the building in question. If there is a smoking area in the building, it is indicated where it is located.

The main tenant is entitled to take measures against offenders of the smoking ban. An offender (a staff member, student or visitor) may be requested to change his or her behaviour or leave the building.

If smokers continue to ignore the smoking ban, the main tenant may decide to take measures. If employees or students violate the smoking ban frequently, disciplinary measures may be taken. Examples of this include a warning or reprimand. Students may be denied access to the building. Anyone who resists the instruction to leave the building is guilty of unlawful entry of a room. Violation of the smoking ban may also be included in the personnel file of the person involved.

what to do in case of complaints about smoking pollution

Address the smoker as regards his or her behaviour, if he or she is smoking in a place where smoking is not permitted.

If this offers no solution, a staff member complaining about smoking pollution may refer to the main tenant of the building or if it concerns a staff member of the own department, to the superior.

The administrators of the units, i.e. the deans (faculties) and directors (group directorates), are responsible for enforcing any agreements made concerning non-smoking of the staff of their unit.
