In this arrangement the following is understood to mean:
- Official jubilee: a jubilee on account of 25 or 40-year employment with the Public Sector or one of its service departments or institutes, including universities, or other government bodies under public law.
- Administrator: the person who according to the Management and Administrative Regulations is charged with the administration of the unit.
- Board: the Executive Board of the university.
- Staff member: the person who is employed by the university.
- University: the University of Twente.
- UT jubilee: a jubilee on account of 12.5 or 25-year employment with the university.
II Official jubilee
- The board informs the administrator of the date of a staff member’s official jubilee, stating the level of the bonus to be granted.
- For the calculation of the years of service the ministerial "Official Jubilee Bonus Scheme " from 1989 is used, including the later changes made by the Ministry of the Interior and Kingdom Relations.
- On the occasion of his 25-year official jubilee the staff member is entitled to a bonus. The bonus consists of 70% of the salary in the month of the jubilee, including the holiday allowance.
- On the occasion of his 40-year official jubilee the staff member is entitled to a bonus. The bonus amounts to 100% of the salary in the month of the jubilee, including the holiday allowance.
- The bonus is paid out in the calendar month in which the jubilee takes place.
- If the board dismisses the staff member in connection with termination of the job, redundancy or a pre-pension scheme (FPU), the staff member is entitled to a pro rata official jubilee bonus, provided the provisions laid down in paragraph 2 have been met.
- The pro rata official jubilee bonus is only granted if the staff member immediately preceding the date of dismissal was in service at the university for an unbroken period of at least ten years and within five years of his dismissal but before reaching the age of 65 years, would be entitled to an official jubilee bonus.
- The pro rata bonus consists of a part of the bonus pro rata the number of years of service, to which the staff member would have been entitled at his official jubilee.
III UT jubilee
- The board informs the administrator of the date of a staff member’s UT jubilee.
- For the application of this clause, years of service is understood to mean the total duration of the employment of the staff member with the university, with the exception of the periods of leave insofar as these last longer than one year. Extraordinary leave in the general interest of more than one year is included in calculating the number of years of service. Employment as a student assistant is not taken into account.
- On the occasion of his 12.5-year UT jubilee the staff member is entitled to a bonus of €230 net. This bonus is paid out in the calendar month in which the jubilee takes place.
- On the occasion of his 25-year jubilee the staff member will receive a silver lapel pin and accompanying certificate.
- If the staff member appreciates this, the chairman of the Board will present the lapel pin referred to in paragraph 6.
- If the staff member appreciates this, publicity will be given to his 25-year jubilee.
- The administrator offers the staff member a reception for the 25-year official jubilee or UT jubilee or the 40-year official jubilee.
- For the 25-year official jubilee and the 25-year UT jubilee the administrator offers one reception in total. In consultation with the staff member it is determined on which occasion the reception will take place.
- If the staff member opts for celebrating his jubilee in another way than with a reception within a university setting, the administrator can grant an allowance for this.
- .The administrator may decide to deviate from paragraph 2 in a way that is positive for the staff member.
- Upon the occasion of the 25-year official jubilee or UT jubilee and at the 40-year official jubilee the staff member is entitled to one calendar day of leave.
- If the 25-year official jubilee and the 25-year UT jubilee do not fall on the same date, the staff member, on the occasion of both events, is in total entitled to one calendar day of leave.
VI Final provisions
- In special cases the Board may deviate from the provisions laid down in this arrangement.
- In cases for which this arrangement does not provide, the Board decides.
- This arrangement becomes effective on 1 July 2010.
Explanation to the IT Jubilee arrangement
Pursuant to clause 3.19, paragraph 1, of the Collective Labour Agreement (CAO) Dutch universities an employee is entitled to a bonus at his service anniversary. The CAO does not provide what a service anniversary is, what the level of the bonus should be and whether the service anniversary involves any other attentions. Pursuant to clause 3.19, paragraph 2 the UT is obliged to set further rules relating to the bonus for the official jubilee. This arrangement provides for this obligation and also serves as an addition to and clarification of clause 3.19, paragraph 1.
Clause 2 Official jubilee
To determine the number of years of service (paragraph 2) the clauses 4 and 5 of the "Official Jubilee Bonus Scheme" of the Minister of the Interior and Kingdom Relations (Government Gazette of 15 November 1989, no. 223) has been taken as starting point; at a later stage a number of changes were made.
These provisions, after having processed the changes, read as follows:
As years of service for granting an official jubilee bonus the time will be considered that was spent:
- in civil service with the Dutch state, including in this context the former NV "Artillerie-Inrichtingen";
- in employment (before 1966) as referred to in Section 4, first paragraph, of the Pensions Act 1922 as well as employment as referred to in Section B2 and B3 of the Public Servants Superannuation Act, and employment as referred to in Section 2 of the Public Servants’ Superannuation (Privatisation) Act;
- in civil service with the government in the countries Surinam (until 25 November 1975), the Netherlands Antilles and Aruba, with the former governments of Suriname, Curacao and New Guinea;
- employed with non-public educational institutions in the countries mentioned under c and former overseas territories, insofar as this brought the interested party under the sphere of influence of a state pension scheme or would have done so had he been in permanent employment;
- up to and including 31 December 1954 in the service of the Republic of Indonesia, insofar as this time is covered by the Act determining the status of Netherlands civil service personnel in Indonesia;
- in Dutch military service or, for the application of the General Civil Service Regulations, similar service, including service with the former Royal Dutch East-Indian Army (KNIL) and the troops in Surinam (until 25 November 1975) and the Netherlands Antilles and Aruba.
- as a voluntary with a full-time job with one of the institutions mentioned under a. up to and including e.;
- the period over which legal rehabilitation has been granted, provided the interested party during this period has filled a position with one of the institutions mentioned under a. up to and including f.
According to article 5 of this circular of the Minister the period filled in a political position, the period of leave (excluding extraordinary leave in the general interest) and fictitious years of service are not taken into account in the calculation.
The salary over which the bonus is calculated (paragraph 3 and paragraph 4) is understood to mean the salary as applicable in the month of the jubilee, including holiday allowance. Expense allowances, allowance for working irregular hours, representation allowance and such are not considered in calculating the bonus.
According to the current tax legislation the gross amount of the bonus can be paid out as a net amount because the bonus is exempt from payroll tax and social security premiums.
Clause 3 Proportional jubilee bonus in case of dismissal
This clause came into existence after it turned out there was less enthusiasm for making use of the pre-pension scheme if this resulted in missing out on the jubilee bonus. Later, this was extended to other forms of termination of employment. The number of years of service are calculated on the basis of clause 2, paragraph 2, of this arrangement.
Clause 4 UT jubilee
To determine the number of years of service (paragraph 2) only the employment with the UT is taken into account. Employment with a privatised part of the University and student-assistantships are not taken into account. If leave is involved that lasts longer than one year, this leave period does not count. Extraordinary leave in the general interest is however always included.
It should be pointed out that in calculating in accordance with this arrangement, an uninterrupted number of years of service is not required. The different employment periods are added to one another.
The presentation of the lapel pin (paragraph 5) by the chairman of the Board is optional. Also the announcement of the 25-year jubilee in the UT news (paragraph 6) is at the choice of the staff member.
Clause 5 Reception
Paragraph 2 states that in the event of the 25-year UT/official jubilee the administrator will offer one reception only. If both jubilees take place on the same day, this is logical indeed. But if these do not fall on the same day, the administrator offers one reception only. In the latter case, the staff member may choose whether this reception is held for his official jubilee or for his UT jubilee.
Clause 6 Leave
Leave concerns one calendar day and not 8 hours. This refers to the fact that if a staff member works half days, he or she does not get two days of leave (= 8 hours in that case), but one day only.
The Dutch text of this regulation is binding. In case of a difference of interpretation, this translation cannot be used for legal purposes.
