Knowledge Migrants Arrangements

As from 1 November 2006 the knowledge migrants arrangement has been extended; the arrangement now applies to all academic researchers employed by the University of Twente. Decisive is the academic job ranking system (UFO), indicated by the job code starting with 01, under job group “research and education”.

The UFO code is explicitly referred to in the appointment letter (confirmation of employment).

Any applications already submitted via the labour migrants arrangement will still be handled via this procedure; this means that the stay will be subject to a work permit.

Academic researchers who are staying on the basis of a work permit can receive an appointment for a maximum of 2 years and 51 weeks. This period follows from the implementing rules under the Foreign Workers Employment Act (Wet Arbeid Vreemdelingen).

Any extension of the appointment is possible via a Wijziging beperking naar kennismigrant (change of restriction according to knowledge migrant). Important in this context is that during the Wijziging beperking procedure both the employee involved and the University of Twente have to have a work permit. To avoid that during the procedure the employee is not allowed to work, such application is to be applied for six months before expiry of the maximum period.

As to the application Wijziging beperking naar kennismigrant the following problem occurs: the handling of these requests is not a priority for the IND and takes months, the consequence being that a student or labour migrant appointed at the UT as a knowledge migrant, when submitting the application Wijziging beperking to the IND in Rijswijk, will receive a sticker in his passport bearing the endorsement: “not allowed to perform labour; work permit required”. With a copy of this sticker a work permit is then as yet to be requested for the person involved. After issue of the work permit de staff member must again contact the IND in Rijswijk to have a new sticker put in his passport stating “Performing labour allowed; work permit required”. Only then is the staff member allowed to actually perform his tasks, and may the University of Twente allow the staff member involved access to his workplace.
