Residence history

The labour migrant who becomes a knowledge migrant via a Wijziging beperking, will retain the residence history he has built up, provided the application for a Wijziging beperking is submitted in time. The request is to be registered with the IND before expiry of the validity of the residence permit. The residence history is important because after 3 years of consecutive stay according to the conditions, the endorsement “Performing labour freely allowed” is obtained. After a residence history of five years built up according to the statutory standard, a request can be submitted for a residence permit for an indefinite period of time provided the person involved still has an appointment/employment agreement for at least 1 year.

If a residence gap emerges for example due to late submission of the application, the residence history is to start again. The same applies to a knowledge migrant who becomes a labour migrant via a Wijziging beperking.

Once the labour market endorsement "Performing labour freely allowed, no work permit required" has been obtained, this will remain unchanged also if the restriction under which the residence permit has been granted to the person involved is changed for a definite period of time (e.g. a labour migrant who after termination of the appointment applies for a wijziging for a stay with his spouse who also works in the Netherlands but is still under the restriction of "work permit required".)
